Event: “Legal Aspects of Export” Training

At the invitation of the Export Promotion Office of Ukraine, Chiron Law Firm conducted a training course on “Legal Aspects of Export” for exporters.

During the training, legal aspects of the organization of work on global markets were considered.

The main points (our approaches to the resolution of legal requests when entering the global markets) are:

  • Legal aspects should be considered before the strategy formation and further at each stage of its formation and implementation (so that it does not have to be adjusted later);
  • Local lawyers will help with local legislation, conflict of laws, and international legislation, but you would better involve foreign or international lawyers (who have offices in their respective jurisdictions) for foreign legal issues;
  • It is better to start with clarifying goals, i.e. which result is expected? Only after you figure out goals, you can further structure your business and agreements (plan from as is to the final result);
  • Besides the goals (“strategic issues”), it is necessary to focus on regulatory issues (taxes, currency, government regulation), financial matters, as well as the comfort of doing business (including cost and safety);
  • What do we need to know about transfer pricing?;
  • What do we need to know about financial monitoring? Where can we check the list of offshore locations, and what are the consequences of working with them?;
  • Opportunities to attract funding from international organizations and foreign countries;
  • Incoterms 2000 and 2010 (ICC announced from 01.01.2020 Incoterms 2020);
  • Intellectual property issues: how to protect your own and not to infringe someone else’s by accident? Open databases to check on Ukrpatent, WIPO, and OHIM.
